1. Acceptance of Terms

By downloading, installing, or using the RodePulse app (“Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms in their entirety, you must not use the Service.

2. Safety Disclaimer

Important Safety Disclaimer — Read Before Using

RodePulse provides proximity alerts as a supplemental safety awareness tool only. It is NOT a substitute for attentive driving, proper road behavior, or compliance with traffic laws.

  • NEVER look at your phone while operating a vehicle.
  • Alerts may be delayed, incomplete, or absent due to GPS accuracy, network conditions, battery state, or other factors outside our control.
  • Do not rely solely on this app for road safety.
  • RodePulse does not guarantee that all nearby motorcycles will be detected or that alerts will fire in all conditions.

By using this Service, you acknowledge these limitations and accept full responsibility for your own safety and the safety of others on the road.

3. Service Description

RodePulse uses anonymous GPS proximity detection to alert drivers when a motorcycle is nearby and approaching. We do not guarantee continuous availability, accuracy, or completeness of proximity alerts. Network conditions, GPS accuracy, battery state, device permissions, and other factors outside our control may affect whether and when alerts are delivered.

4. Eligibility

You must be at least 17 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement and that your use of the Service complies with all applicable local, state, and national laws and regulations.

5. Acceptable Use

You agree NOT to:

  • Use the Service to harass, stalk, or track any individual
  • Attempt to identify, de-anonymize, or correlate other users of the Service
  • Reverse-engineer, scrape, abuse, or conduct denial-of-service attacks against the Service infrastructure
  • Use the Service in violation of any applicable law or regulation, including traffic laws and privacy laws
  • Interfere with the proper operation of the Service or degrade other users' experience
  • Use the Service for any commercial purpose without our prior written consent

We reserve the right to terminate access for any user who violates these terms.

6. Intellectual Property

The RodePulse app, including its source code, design, branding, and all related materials, is owned by RodePulse and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the app solely for personal, non-commercial road safety purposes, subject to these Terms. No other rights are granted.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. RODEPULSE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS. RODEPULSE DOES NOT WARRANT THAT ALL NEARBY MOTORCYCLES WILL BE DETECTED OR THAT ALERTS WILL FIRE IN ALL CONDITIONS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RODEPULSE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, BODILY HARM, PROPERTY DAMAGE, LOSS OF DATA, LOSS OF REVENUE, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF RODEPULSE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL RODEPULSE'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of such courts.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be reflected with an updated “Effective date” at the top of this page. We encourage you to review these Terms periodically. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
